12.851<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-5101\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"1\" role=\"region\" aria-labelledby=\"elementor-tab-title-5101\"><p><strong>ART\u00cdCULO 32.-<\/strong> Se instituye con la denominaci\u00f3n JUS a la unidad de honorario profesional del abogado o procurador, que representa el dos por ciento (2%) de la remuneraci\u00f3n total -deducidos los adicionales porcentuales particulares- asignada al cargo del Juez de Primera Instancia de Distrito de la Provincia de Santa Fe.<\/p><p style=\"text-indent: 125px;\">Toda regulaci\u00f3n de honorarios deber\u00e1 contener, bajo pena de nulidad, el monto expresado en pesos o moneda de curso legal y la cantidad de unidades JUS que \u00e9ste representa a la fecha de la resoluci\u00f3n. El pago ser\u00e1 definitivo y cancelatorio \u00fanicamente si se abona la cantidad de pesos o moneda de curso legal que resulte equivalente a la cantidad de unidades JUS contenidas en el auto regulatorio, seg\u00fan su valor vigente al momento del pago.<\/p><p style=\"text-indent: 125px;\">Bajo la misma sanci\u00f3n, la resoluci\u00f3n deber\u00e1 expresar tambi\u00e9n el inter\u00e9s moratorio aplicable, el que ser\u00e1 dispuesto prudencialmente por los jueces, teniendo en cuenta las vicisitudes del mercado, el valor adquisitivo de la moneda y el car\u00e1cter alimentario del honorario profesional, pudiendo alcanzar hasta una vez y media la tasa activa capitalizada del Nuevo Banco de Santa Fe S.A. para las operaciones de descuento de documentos.<\/p><p style=\"text-indent: 125px;\">La Corte Suprema de Justicia de la Provincia de Santa Fe publicar\u00e1 peri\u00f3dicamente el valor de la unidad JUS a los fines arancelarios.<\/p><p style=\"text-indent: 125px;\">Si de acuerdo con la ley de fondo, resultara procedente la actualizaci\u00f3n monetaria por aplicaci\u00f3n de los \u00edndices de precios al consumidor confeccionados por el Instituto Nacional de Estad\u00edstica y Censos, corresponder\u00e1 aplicar dicho \u00edndice sobre el monto nominal consignado en la regulaci\u00f3n en pesos o moneda de curso legal. Pero si el valor de la unidad JUS se hubiera incrementado durante el mismo per\u00edodo, corresponder\u00e1 cotejar ambas cantidades, debi\u00e9ndose abonar el monto que resulte mayor al tiempo del pago.<\/p><p style=\"text-indent: 125px;\">A estos fines, los honorarios regulados transcurridos un mes desde que se encuentren firmes a petici\u00f3n de los profesionales interesados o de la Caja Forense, podr\u00e1n ser actualizados teni\u00e9ndose en cuenta el \u00edndice mencionado en este Art\u00edculo. Las actualizaciones que se efect\u00faen se computar\u00e1n para los aportes a las Cajas Forense y de Jubilaciones y Pensiones de Abogados y Procuradores.<\/p><p style=\"text-indent: 125px;\">La solicitud de reajuste deber\u00e1 notificarse tambi\u00e9n en el domicilio real de la parte a cuyo cargo se encuentra el pago de los honorarios con el fin de que \u00e9sta formule las observaciones que crea menester dentro del plazo de tres d\u00edas, vencido el cual el tribunal resolver\u00e1 sin m\u00e1s tr\u00e1mite.
