CECILIA MOREAU<\/strong><br><br>\n\n<span style=\"text-decoration: underline;\">Su Despacho:<\/span><br><br>\n<p style=\"text-indent: 100px; text-align: justify;\">Quienes suscribimos la presente, integrantes de la Mesa Ejecutiva del <em>\u201cConsejo Coordinador de Cajas de Previsi\u00f3n Social para Abogados y Procuradores de la Rep\u00fablica Argentina\u201d<\/em>, nos dirigimos formalmente a Ud. y por su intermedio a las y los dem\u00e1s legisladores que integran la C\u00e1mara de Diputados de la Naci\u00f3n, a efectos de manifestarles nuestro total y absoluto rechazo al Proyecto de Ley N\u00b0 1762-D-2023, presentado por el Diputado Nacional Mart\u00edn Tetaz que pretende instaurar las Sucesiones Administrativas en la normativa de derecho positivo de nuestro pa\u00eds, incorporando un Procedimiento Administrativo que se tramitar\u00eda ante un organismo dependiente del Poder Ejecutivo (Registro Nacional de las Personas).<\/p>\n<p style=\"text-indent: 100px; text-align: justify;\">El ordenamiento jur\u00eddico argentino establece declaraciones, principios, garant\u00edas constitucionales y procedimientos legales establecidos en el C\u00f3digo Civil Argentino que garantizan a las personas el debido control jurisdiccional en cuestiones tan relevantes como la transmisi\u00f3n de derechos por causa de muerte <em>(Libro Quinto, art. 2277 a 2531 y cctes.).<\/em><\/p>\n<p style=\"text-indent: 100px; text-align: justify;\">La potestad jurisdiccional es exclusiva de los jueces designados constitucionalmente como integrantes del Poder Judicial (Art., 18\u00b0, 75\u00b0 inc. 12, 108\u00b0 y 116\u00b0 C.N.) y no puede ser sustituida sin grav\u00edsima afectaci\u00f3n de la divisi\u00f3n de funciones derivada de la forma republicana de gobierno (Art. 1\u00b0 C.N.).<\/p>\n<p style=\"text-indent: 100px; text-align: justify;\">Esto es motivo suficiente para su total rechazo; sin perjuicio de ello, el proyecto significa adem\u00e1s una grave afectaci\u00f3n a la incumbencia profesional de la Abogac\u00eda como actividad legal regulada.<\/p>\n<p style=\"text-indent: 100px; text-align: justify;\">Por \u00faltimo, la implementaci\u00f3n del P.A.S. afectar\u00eda significativamente los recursos de las Cajas de Previsi\u00f3n de Abogados y Procuradores de todo el pa\u00eds, poniendo en riesgo su sustentabilidad, lo que repercutir\u00eda directamente en el Sistema Previsional Argentino, toda vez que el proyecto siquiera analiza estas consecuencias.<\/p>\n<p style=\"text-indent: 100px; text-align: justify;\">Motivos por los cuales exhortamos a las autoridades Legislativas Nacionales que se rechace absolutamente el mencionado proyecto de ley y se disponga su
